By visiting our website (https://www.clarityfinancial.com.au/), utilising our financial tools, or engaging our mortgage broking services, you consent to the data practices described in this policy.

1. Information We Collect

To provide you with credit assessments, loan structuring, rate negotiations, and application management, we must collect information that identifies you or forms your financial profile. Depending on your interactions with us, we may collect:

  • Identity Details: Your name, residential address, date of birth, and contact details (email address and phone numbers).
  • Financial Profile Data: Details of your income, employment history, household expenses, assets, existing liabilities, and credit history reports.
  • Property & Transaction Details: Information regarding the properties you wish to purchase, purchase price, deposit amounts, government concession eligibility, and details of solicitors or real estate agents involved in your transaction.

2. Sensitive Information

We will only collect sensitive information about you with your consent. Sensitive information is personal information that includes information relating to your racial or ethnic origin, political persuasion, memberships in trade or professional associations or trade unions, sexual preferences, criminal record, or health.

3. How We Collect Your Information

We prioritise collecting your personal information directly from you wherever it is reasonable and practicable to do so. This occurs when you:

  • Complete an online inquiry, fill out our client intake systems, or use our digital loan and borrowing capacity calculators.
  • Engage with our mortgage brokers via telephone, email, or face-to-face appointments at our Canberra office.
  • Upload financial verifications, payslips, or tax statements to our processing systems.

With your consent, we may also collect information from third parties, such as credit reporting bodies, your employer to verify income details, or your nominated real estate agents, accountants, and solicitors.

4. Business Without Identifying You

In most circumstances, it will be necessary for us to identify you in order to successfully do business with you. However, where it is lawful and practicable to do so, we will offer you the opportunity of doing business with us without providing us with personal information, for example, if you make general inquiries about interest rates or current promotional offers.

5. Using Government Identifiers

If we collect government identifiers, such as your tax file number, we do not use or disclose this information other than required by law. We will never use a government identifier in order to identify you.

6. How We Use Your Information

We collect, hold, use, and disclose your personal information for the primary purpose of providing mortgage broking and financial credit services. This includes:

  • Assessments: Understanding exactly how much you can borrow based on your income, expenses, and financial situation before starting a property search.
  • Loan Structuring & Negotiation: Sourcing, structuring, and negotiating home loan terms with our strong relationships across over 40 lenders.
  • Application Management: Handling the paperwork, securing loan pre-approvals, and guiding you through the home buying journey with clear, tailored advice.
  • Compliance: Satisfying our statutory obligations under the National Consumer Credit Protection Act 2009 (Cth) and general regulatory requirements.

7. Who We Share Your Information With

To deliver our services effectively, we may disclose your personal information to third-party organisations outside of Clarity Home Loans. These disclosures are performed under secure conditions and only to parties required to execute your request:

  • Lenders and Credit Providers: Financial institutions and lenders on our panel to whom your loan application is directed.
  • Professional Associates: Your designated solicitor, conveyancer, or real estate agent to ensure a smooth transaction.
  • Credit Reporting Bodies: To pull necessary consumer credit files as part of the assessment phase.
  • Regulatory Bodies: Government authorities, law enforcement agencies, or dispute resolution schemes where mandated by Australian law.

Our brokers do not earn commissions—ever. Instead, they are paid a consistent salary plus performance-based bonuses that stay the same no matter which lender or loan they recommend. Your data is utilised solely to secure the right loan for you, driven by compliance and client satisfaction.

8. How Safe and Secure is Your Personal Information That We Hold?

We will take reasonable steps to protect your personal information by storing it in a secure environment. We may store your personal information in paper and electronic form. We will also take reasonable steps to protect any personal information from misuse, loss, and unauthorised access, modification, or disclosure.

When your personal data is no longer necessary for any authorised purpose, or required to be held under Australian financial record-keeping laws, we will take reasonable steps to securely destroy or permanently de-identify it.
